Terms of Service

These terms govern your use of the XSeller.AI website and, where applicable, the XSeller.AI AI phone agent service ("the Service"). By using the website or the Service, you agree to these terms.

1. The Service

XSeller.AI provides AI voice agents that answer calls, book appointments, qualify leads and follow up on behalf of businesses. Specific features, availability and pricing are agreed with each customer separately. We may improve, change or withdraw features over time.

2. Demos and bookings

Booking a demo through this website does not create an ongoing contract. Any paid engagement is governed by a separate agreement between you and XSeller.AI. Quotes and pricing discussed in a demo are indicative until confirmed in writing.

3. Acceptable use

  • You must not use the website or Service unlawfully, or to harass, defraud or harm others;
  • You must not attempt to disrupt, reverse engineer or gain unauthorised access to our systems;
  • If you use the Service for your business, you are responsible for ensuring your use of call recording and customer contact complies with the law that applies to you.

4. AI generated voice and content

The Service uses an automated AI voice agent. While we work to make it accurate and helpful, AI systems can make mistakes. You are responsible for reviewing important outcomes (such as bookings) and we are not liable for losses arising from reliance on automated outputs except as required by law.

5. Intellectual property

The website, branding and underlying software are owned by XSeller.AI or its licensors. You may not copy or reuse them without permission. The sample call recordings on this site are illustrative and AI generated.

6. Privacy

Our handling of personal information is described in our Privacy Policy.

7. Liability

To the extent permitted by law, the website and Service are provided "as is", and we exclude implied warranties. Nothing in these terms limits rights you may have under the Consumer Guarantees Act 1993 or other laws that cannot be excluded. Our total liability is limited to the amount you have paid us for the Service in the preceding 12 months.

8. Governing law

These terms are governed by the laws of New Zealand, and the New Zealand courts have nonexclusive jurisdiction.
